Un marco ético para la generación de confianza en las fundaciones

Abstract

Como instituciones de la sociedad civil las fundaciones persiguen fines de interés general, ejerciendo un doble rol: defender los derechos de las personas y ofrecer bienes y servicios para la satisfacción de necesidades, complementando la labor que el Estado realiza de manera insuficiente. A pesar de desarrollar estas actividades loables, las fundaciones no siempre se comportan éticamente, existiendo fraude, falsificación de resultados, puertas giratorias, falta de trasparencia y rendición de cuentas, etc. Esta investigación pretende aportar un marco ético para la generación de confianza en las fundaciones. Para orientarlas responsablemente, abordando los problemas de la práctica fundacional y aprovechando las oportunidades y fortalezas que ya poseen. Nuestro marco se adapta a las características y contextos de cada fundación, guiándolas estructural y organizacionalmente, sin perder el horizonte de actuación moral: el interés general o la defensa y promoción de los DDHH. Encaminándolas a convertirse en verdaderos agentes de justicia.

The aim of this doctoral thesis is to develop a proposal for foundation ethics capable of facing the challenges derived from the defense and promotion of human rights. The chosen methodology is critical hermeneutics, empirically complemented with a qualitative study of 376 foundations from the universe of 16,175 existing foundations in Spain, with a confidence interval of 95% and a margin of error of 5%. The starting hypothesis is that it is possible and necessary to design applied ethics for foundations that: bases their character as agents of justice and provides the necessary mechanisms for its implementation. It concludes with the ethical framework that allows addressing the weaknesses and threats, and taking advantage of the opportunities and strengths that have been identified, without losing the horizon of moral action: the fulfillment of its purposes of general interest, defense and promotion of human rights.
