Los pueblos indígenas y la protección de sus convicciones religiosas ante conflictos de acaparamientos de tierras y aguas

Abstract

Esta tesis doctoral tiene por objeto reafirmar la singularidad del derecho de libertad de religión o de creencias de los pueblos indígenas, que se ve irremediablemente violado en los conflictos de acaparamientos de tierras y aguas que acechan la integridad de sus territorios tradicionales. Sus convicciones religiosas se encuentran íntimamente ligadas a sus tierras ancestrales por medio de una profunda conexión espiritual que constituye la base esencial de sus sistemas de creencias y que define su identidad grupal, todo lo cual se aleja de los parámetros euroccidentales al respecto. Estas creencias nuclean su lucha por el respeto y goce efectivo de sus derechos humanos, fortaleciéndola inmensurablemente. A través de los métodos inductivo y comparado y de un análisis casuístico crítico y riguroso a distintos niveles, la presente tesis demuestra que la violación de este derecho ocurre en un considerable volumen de casos de acaparamientos de tierras indígenas alrededor del mundo.

This doctoral thesis aims to reaffirm the uniqueness of the right to freedom of religion or belief of indigenous peoples, which is irretrievably violated in land and water grabbing conflicts that threaten the integrity of their traditional territories. Their religious convictions are inextricably linked to their ancestral lands through a deep spiritual connection that forms the essential basis of their belief systems and defines their group identity, all of which moves away from Euro-Western parameters in this regard. These beliefs lay at the core of their fight for the respect and effective enjoyment of their human rights, strengthening it immeasurably. Through the inductive and comparative methods and a rigorous and critical case study at different levels, this dissertation demonstrates that the violation of this human right happens in a considerable amount of land-grabbing cases of indigenous peoples all around the world.
