La protección activa de la Policía Nacional en la violencia de género

Abstract

La violencia de género, es un problema social, basado en el género, que ha nivel mundial ha alcanzado dimensiones pandémicas. Desde 1995, la (ONU), “IV Conferencia Mundial”, la estableció como la principal causa de desigualdad entre hombres y mujeres. En España, con la Constitución de 1978 y tras la L.O. 1/2004 (LOIVG) se ha establecido toda una evolución normativa en favor de los derechos de las mujeres y en contra de la violencia de género, convirtiendo los malos tratos hacia las mujeres como un tipo de violencia estructural. El Cuerpo Nacional de Policía, desde su constitución (1986) se ha especializado en este tipo de delitos. A través de esta tesis, de forma transversal, se llevará a cabo, la investigación sobre el posicionamiento del Cuerpo Nacional de Policía como elemento esencial de protección para las mujeres y fundamental para el acceso de las mismas a la justicia y a los mecanismos de protección social.

The thesis is divided into four sections, the first chapter begins with the contextual and conceptual aspects of gender violence; beginning with a polyhedral vision to continue with the determination of the legal framework and end with an empirical vision of gender violence. The second chapter gives a public consideration of gender violence, the normative evolution and the evolution of the protection system from the perspective of the intervention of the National Police from an evolutionary point of view, in which the parallelism between the legal evolution on the matter and the evolution of the National Police from an institution of protection to the regime it serves, to become an institution dedicated to the protection of citizen security in general and with the specialty of protection of women victims of gender violence. The third chapter is intended to develop the specific intervention that the National Police carries out in the protection of women victims of this crime. The creation and subsequent evolution of the current Family and Women's Units, dedicated exclusively to the investigation and protection of women victims of the crimes established in Organic Law 1/2004 on comprehensive protection measures against gender violence. The fourth is intended for the synergies that occur in the action of the National Police with the rest of the services designed to care for, advise and protect women victims of this crime, health services, assistance, women's centers, assistance offices for the victim and shelters, ending with the social assistance that they have at their disposal, as well as the telematic and telephone services that are available.
