La reforma del Principio de Justicia Universal y el delito de tráfico de drogas

Abstract

El objeto de la tesis doctoral parte del análisis de la nueva legislación referente a la aplicación de la jurisdicción española en los casos de tráfico de drogas, en los que el buque o nave haya sido interceptado en aguas internacionales, por la modificación sufrida en marzo del 2014 del art. 23 de la Ley Orgánica del Poder Judicial en relación con el tipo penal de tráfico de drogas.

En la presente tesis se analiza la norma nacional en relación con los convenios internacional, así como los distintos pronunciamientos judiciales en la materia, para determinar que la restricción a la aplicación del principio de justicia universal llevada a cabo por el legislador nacional ha de ser revisada y aplicada respetando los compromisos internacionales a los que España se ha obligado en materia de tráfico de drogas.

The purpose of the doctoral thesis is based on the analysis of the new legislation concerning the application of Spanish jurisdiction in cases of drug trafficking in which the vessel or vessel has been intercepted in international waters, due to the change suffered in March 2014 of art. 23 of the Organic Law of the Judicial Branch in relation to the criminal type of drug trafficking.

This thesis analyzes the national norm in relation to the international conventions, as well as the different judicial pronouncements in the matter, to determine that the restriction to the application of the principle of universal justice carried out by the national legislator has to be revised And applied in compliance with the international commitments to which Spain has committed itself in the field of drug trafficking
