Intervención delictiva: significado y función del principio de accesoriedad

Abstract

De la mano de una teoría de las normas integradora, este trabajo somete el principio de accesoriedad de la participación a un doble análisis: por un lado, en el nivel de la norma primaria, aspira a elucidar su significado y función en tanto nexo que vincula distintos comportamientos individuales ejecutados en un contexto de división del trabajo; por otro lado, en el nivel de la norma secundaria, procura señalar cuáles son los requisitos del hecho principal que habilitan a castigar a un interviniente a título de cooperador o inductor. Asimismo, la investigación propone, entre otras cosas, una minuciosa explicación de las particularidades inherentes a la intervención previa al comienzo de ejecución. El tratamiento de estas cuestiones se encuentra precedido de una revisión crítica del estado de la discusión, así como de las premisas que subyacen a la tradicional teoría de la intervención en lo que respecta al fundamento del injusto del partícipe.

Geführt von einer integrierenden Normentheorie unterzieht diese Arbeit das Prinzip der Akzessorietät der Teilnahme einer Doppelanalyse: Einerseits auf der Ebene der Primärnorm, strebt sie es an seine Bedeutung und Funktion als Relation zu erläutern, die verschiedene individuelle Verhalten verbindet, die in einem Arbeitsteilungszusammenhang ausgeführt werden; andererseits auf der Ebene der Sekundärnorm, versucht sie festzulegen, welche die Anforderungen der Haupttat sind, die es befähigen einen Beteiligten als Gehilfe oder Anstifter zu bestrafen. Desgleichen wird von der Untersuchung unter anderem eine ausführliche Erklärung der innewohnenden Umstände der Beteiligung vor Anfang der Tatausführung vorgeschlagen. Der Handhabung dieser Fragen geht eine kritische Überarbeitung der Diskussionslage voraus, sowie auch der Voraussetzungen, die der traditionellen Theorie der Beteiligung zugrunde liegen, hinsichtlich des Strafgrunds des Unrechts des Teilnehmers.

Led by an integrative theory of norms, this piece of work subjects the principle of accessoriness of participation to a double analysis: on the one hand, at the level of the primary norm, it aspires to explain its meaning and function as a relation that links different individual behaviours carried out in a division of labour context; on the other hand, at the level of the secondary norm, it endeavours to set which are the requirements of the main offence that enable a participant to be punished as an accomplice or instigator. Likewise, the investigation proposes, among other things, a detailed explanation of the circumstances inherent in the intervention that takes place prior to the start of the execution of the offense. The treatment of these questions is preceded by a critical review of the state of the discussion, as well as of the assumptions underlying the traditional theory of intervention, with regard to the punishment ground of the participation.
