Abstract

En esta tesis se aborda el procedimiento de modificación de medidas desde la constatación que constituye un indicador privilegiado del derecho de familia español en relación la sociedad y a sus cambios; por ello, desde esta perspectiva, se analiza la Ley de Divorcio de 1981, sus antecedentes históricos y sus modificaciones. Igualmente se analizan cuantitativamente las acciones judiciales relacionadas con la familia y el papel que, dentro de ellas, tienen los procedimientos de modificación de medidas. Todo ello, desde la premisa de la naturaleza líquida de la sociedad, en la acepción acuñada por Zygmunt Bauman, y su afectación sobre las relaciones familiares. De todo ello se infiere el divorcio existente entre norma y procedimiento, por un lado, y realidad social por otra, lo que se constata con el análisis de las respuestas (o no-respuestas) normativas y jurisdiccionales a las realidades sociales en torno a la familia, caracterizadas por su naturaleza vinculada a la naturaleza líquida de la sociedad y su manifestación en forma de relaciones únicamente ancladas en el amor y la voluntad y, en consecuencia, globalmente de duración limitada; en un contexto de incertidumbres, inseguridades y cambios permanentes. Se evidencia lo refractario del sistema normativo ante realidades como las constelaciones familiares reconstituidas o las consecuencias en el ámbito familiar de la falta de perspectiva económica, y con ella del surgimiento del precariado. Y se constata que el precitado divorcio entre sistema y sociedad ha tenido como consecuencia que, de la misma manera que de forma creciente las familias se constituyen y deshacen al margen de la norma, también adaptan sus relaciones tras la ruptura, aún habiendo medidas acordadas judicialmente, a su libre albedrío, con el riesgo latente que ello supone para la parte más débil y, especialmente, para los menores cuando lo hay. En estos escenarios líquidos las resoluciones judiciales en materia de familia entran en deflación, en ocasiones se dictan ya obsoletas y conducen a cuestionar la certeza del derecho, de forma especial, del que dimana directamente de un código. Unas medidas dictadas judicialmente con vocación de permanencia en el tiempo lo que, al contraponerlo con la realidad líquida, no deja de constituir una mera e inocua declaración retórica. La actual configuración del procedimiento de modificación de medidas precisa de una reforma que le acerque a la realidad líquida de la sociedad, para lo cual es imprescindible que el sistema deje de entender las medidas como “definitivas” y su modificación vista únicamente desde la excepcionalidad; de ahí la propuesta de lege ferenda que se formula partiendo de la premisa que la excepcionalidad no la constituye el cambio sustancial de circunstancias al que alude la norma sino, precisamente, la excepción la constituye, en cualquier caso, el mantenimiento en el tiempo de la ratio decidenci.


This thesis tackles proceedings for the varying of terms in court orders based on the assertion that they are a privileged factor in Spanish family law in relation to society and its changes; the 1981 Divorce Law, its historical antecedents and its modifications are analysed from this perspective. The thesis also makes a quantitative analysis of judicial cases in family law and the role played within them by proceedings for the varying of terms. All of this is based on the premise of the liquid nature of society, in the sense coined by Zygmunt Bauman, and its effect on family relationships. From this, it is inferred that a divorce exists between regulation and legal proceedings on the one hand, and social reality on the other; this is asserted by analysing the regulatory and legislative responses (or lack thereof) to the social realities surrounding the family, characterised by their nature in connection with the liquid nature of society, and the manifestation of them in the form of relationships only founded on love and will, and, consequently, of limited duration overall, in a context of uncertainties, insecurities and permanent changes. Evidence is shown for the refractory nature of the regulatory system in the face of realities such as reconstituted family constellations or the consequences within the family unit of the lack of economic perspective, and with it the emergence of the precariat. It is also asserted that the aforementioned divorce between system and society has resulted in the consequence that, just as families are increasingly formed and broken up without legal recognition, their relationships are also adapted at their free will following the split, including when there are terms agreed in court, with the latent risk which this implies for the weakest party and, especially, for children, if there are any. In these liquid scenarios, family law rulings enter into decline, they are sometimes already obsolete when pronounced and this leads to questioning the certainty of law, especially when it derives directly from a code. Terms pronounced in court as permanent, in contrast to liquid reality, are merely innocuous rhetorical declarations. The current shape of proceedings for the varying of terms is in need of reform to bring it closer to the liquid reality of society, for which it is essential that the system stops understanding the terms as "definitive" and the varying of them only as exceptional; hence the proposal of lege ferenda, which is formulated on the premise that exceptionality does not mean the substantial change of circumstances to which the law alludes but, in any case of law, it is precisely the maintaining forever of the ratio decidenci which is the exception.
