Abstract

Climate is defined by a particular trait: its natural and gradual transformation. However, for several years now the international scientific community has warned that climate patterns are changing dangerously and rapidly. This is mainly due to the burning of fossil fuels but also to other human activities such as deforestation and changes in land use that fail to retain enough greenhouse gases that are expelled and end up concentrating in the atmosphere and warming the planet.

As a result of global warming, various elements of the climate system are subject to irreversible damage. The loss of the ice poles, for example. Likewise, meteorological phenomena present themselves with an unusual frequency and intensity that affect people, their loved ones and their assets. Rather strikingly, although the risk that damage may occur is crystal clear, at the end of the day no one may be held responsible for the same.

Therefore, this doctoral work encompass the issue of climate change and the applicable law to it. Even though the Urgenda case has created a school for us, we have noticed in today date that the law suits had increased around the world. It is imperative that we take a look and analyze if in fact all the budget forecasted to all the damages are happening or being paid and if they at what scale. This is a suspicious theory that came up from a jurisdictional institutional debate in which its outcome ended preforming/saying less than what it was intended for

El clima té una característica fonamental, com és la seva transformació natural i gradual. Tanmateix, des de fa molts anys la comunitat científica internacional ha advertit que les condicions climàtiques estan canviant ràpidament i perillosa. Això es deu, principalment, a la quantitat de combustibles fòssils consumits però també a altres activitats humanes com la desforestació i els canvis en l'ús del sòl que no permeten retenir els gasos suficients amb l'efecte d'hivernacle que els gasos emesos s’acaben concentrant en l'atmosfera i l'escalfament del planeta.

Com a conseqüència d'aquest escalfament global, diversos elements del sistema climàtic estan subjectes a danys irreversibles. La pèrdua dels pols, per exemple. Així mateix, els fenòmens meteorològics es presenten amb una freqüència i una intensitat inusuals que afecten les persones, els seus éssers estimats i el seu patrimoni. El que més crida l’atenció de tot plegat és que malgrat el risc que hi hagi un dany, ningú no n’és responsable.

Per això, aquest treball doctoral aborda la problemàtica del canvi climàtic i l’aplicació del dret. Si bé arran del cas Urgenda s'ha creat escola i avui dia proliferen les demandes climàtiques per tot el món, és oportú aturar-nos un moment i analitzar si efectivament hi concorren tots els pressupostos de la responsabilitat per danys i en quina mesura. Aquesta interrogant neix de la sospita que la institució esmentada apareix en el debat jurídic però el rol que acaba exercint és molt menys decisiu al que li correspondria
